An appeals court has revived Annie Leibovitzโs agencyโs copyright lawsuit against an online magazine over its use of her photographs from the Star Wars movie set.
KUALA LUMPUR, May 8 โ Baโkelalan Assemblyman Baru Bian has filed an application to strike out a lawsuit brought against him by Parti Keadilan Rakyat (PKR), which is seeking RM10 million in damages over an alleged breach of bond conditions after he left the party following the 14th General Election (GE14) in 2018.
The notice was filed through Messrs YH Teh & Quek on April 6 on the grounds that the High Court of Malaya in Peninsular Malaysia does not have jurisdiction to hear the case because the cause of action arose in Sarawak.
The court has fixed May 20 for case management before High Court judge Roslan Mat Nor.
In his application, Baru Bian, who is also a former Member of Parliament (MP) for Selangau, said he signed the bond in Kuching on April 25, 2018 and that his involvement with PKR was solely centred in Sarawak.
โThe plaintiffโs actions against me, even if proven true, do not arise in Peninsular Malaysia. The claim arises in Sarawak,โ he stated in the application.
Baru Bian is among 16 former MPs and assemblymen being sued by PKR secretary-general Datuk Dr Fuziah Salleh on behalf of the party for allegedly breaching the terms of a RM10 million bond signed with PKR.
Others named as defendants are Datuk Kamarudin Jaffar, Datuk Mansor Othman, Datuk Mohd Rashid Hasnon, Datuk Seri Saifuddin Abdullah and Datuk Seri R. Santhara Kumar.
Also named are Abdul Yunus Jamhari, Datuk Azman Nasrudin, Dr Afif Bahardin, Chong Fat Full, Daroyah Alwi, Haniza Mohamed Talha, Muhammad Hilman Idham, Muhammad Jailani Khamis, Robert Ling Kui Ee and Zulkifli Ibrahim.
In separate suits filed on February 19 and 27, PKR claimed that under the operative clause of the bond, each defendant had agreed to pay RM10 million to the party within seven days of triggering events such as resigning from the party, joining another political party or becoming an independent elected representative.
The plaintiff said it had nominated each defendant as a candidate in GE14, where they successfully won parliamentary and state seats, contributing to the formation of the federal government and several state governments.
However, on February 24, 2020, each defendant ceased to be a party member after being elected under the party banner. They also expressed support for political coalitions other than PKR,โ the party stated in its statement of claim.
PKR further stated that on March 11, 2020, the party decided to terminate the membership of each defendant with immediate effect.
Certificates dated March 16, 2020, were subsequently issued confirming the termination of their memberships, along with demands for payment of the RM10 million bond, which the defendants allegedly failed to settle. โ Bernama
LONDON, May 8 โ Google faces a fresh UK lawsuit accusing it of abusing its dominance in online display advertising, the claimants announced yesterday, in the latest antitrust action against the US tech giant.
The claim filed on behalf of British advertisers is seeking up to ยฃ3 billion (RM15.6 billion) in compensation, according to an estimate from KP Law, the firm leading the action.
The case argues that Google favoured its own display advertising services, such as banner ads shown on websites, while excluding its rivals.
KP Law said Googleโs practices left โadvertisers paying more for less effective display advertisingโ.
A Google spokesperson called the allegations โmeritlessโ.
โAdvertisers have many choices, and they choose our ad tech tools because theyโre simple, effective and affordable,โ the spokesperson said.
The case has been brought as a collective action, meaning all potentially affected clients are automatically included unless they choose to opt out.
It covers all UK advertisers who have paid for Googleโs advertising services since October 1, 2015.
The claim was yet to be formally served, according to Google.
The companyโs advertising practices have been the subject of multiple investigations and legal proceedings in the UK, the European Union and the United States.
A separate lawsuit filed in UK courts last year also accused Google of overcharging for online advertising.
Other cases on similar grounds are ongoing, including a ยฃ13.6 billion claim brought on behalf of online content publishers, which was cleared in 2024 to proceed to trial.
Google is also facing efforts by the US government to break up its digital advertising business to curtail its dominance.
Last year, the EU hit Google with a massive 2.95-billion-euro antitrust fine for favouring its own advertising services.

SINGAPORE: Three passengers who had been injured on SQ321, which experienced severe turbulence on May 21, 2024, are suing Singapore Airlines.
The flight departed from London Heathrow and was bound for Singapore. It had been in the air for more than 10 hours and was at 37,000 feet when the incident occurred. It resulted in one fatality and multiple injuries to the 211 passengers and 18 crew members on board.ย
The turbulence caused the plane to fall by 178 feet (54.25 m) in less than five seconds and by 6,000 feet (1.8 km) in around five minutes.
The plane then made an emergency landing in Bangkok, where 104 passengers and crew were hospitalised, with 20 needing surgery or intensive care.
Lawsuit in UK High Court
And now, passengers Bradley Richards, Benjamin Read, and Alison Read have filed personal injury compensation lawsuits in the United Kingdom and are being represented by Keystone Law. The family of 73-year-old Geoff Kitchen, who died from a suspected heart attack in the aftermath of the turbulence, is not involved in the lawsuit.
Mr Richards, 31, sustained a head laceration that needed 20 stitches, multiple spinal fractures, and a spinal epidural hematoma. The telecoms engineer has said that the injuries he sustained may end his career.
Mr Read, meanwhile, suffered from neck injuries, and his wife, Ms Read, had a concussion that led to a seizure. Their son, then two years old, had fortunately been uninjured.
Reports say that Singapore Airlines has yet to respond to the claim.
According to one article, this is the first significant turbulence-injury litigation in UK courts in a generation.
While the final report from the investigation into the incident is likely to be released later this year, initial findings showed that there were no aircraft maintenance faults. The investigation was carried out by the Civil Aviation Authority of Singapore, with representatives from the UKโs Air Accidents Investigation Branch and the US National Transportation Safety Board.
What the plane encountered was understood to be an incident of clear-air turbulence, when pilots are unable to detect the irregular motions that create disturbances.
Singapore Airlines gave passengers full fare refunds and offered $10,000 for passengers with minor injuries. For those with more serious injuries that need longer care, the airline offered $25,000 in advance payments. These, however, were explained to be merely partial payments. /TISG
